(‘Terms’)
Introduction (summary)
These Terms and Conditions (“Terms”) govern your access to and use of Jaabla (https://jaabla.com/ (“Jaabla”, “we”, “us”, “our”). By using Jaabla you agree to these Terms. Jaabla operates a platform that connects event organisers (“Members” or “Buyers”) with people who provide speaking services (“Speakers” or “Vendors”).
We may modify and update these Terms at any time, without notice. Users need to review the Terms from time to time. The amended Terms will then take effect from the next time a User logs into the Website or uses the Website.
In using our Website and Services, you agree to be bound by these Terms as well as any and all general Terms and Conditions and our Privacy Policy that is posted on our website from time to time. If you do not accept these Terms, you are not permitted to use our website services.
- Definitions & Parties
- Contentmeans any and all materials, links, words, images that may be uploaded or added to the Website by any User.
- Engagementmeans any speaking event, presentation, conference, panel, ceremony, seminar, workshop or other similar group or individual event.
- Jaabla, Us, wemeans t/a Jaabla (ABN 19 302 347 622)
- Member means a person or organisation using Jaabla to find and hire a Speaker.
- Speaker means a person or entity listing their speaking services on Jaabla.
- Servicesmeans the digital platform where Members can find and hire Speakers for speaking engagements, conferences, panels, presentations, webinars, eulogies, wedding celebrancy, etc.
- User, you means both Speakers, and Members who may engage the Services via the Website.

How It Works
Jaabla offers a dynamic platform designed to connect professional speakers with organisations, event planners and individuals seeking engaging, informative and inspiring presentations for their Engagement.
Speakers: if you are a professional speaking, coach, consultant or thought leader, Jaabla offers you the opportunity to create a personalised profile to showcase your expertise, experience and available services.
Members: Members including organisations can sign up to browse and search our curated database of professional speakers by topic, industry, location or event type. Detailed profiles help you to evaluate the best speaker for your event. You can easily book them directly through the Jaabla platform.
- Role of the Website
1.1 We facilitate the opportunity for the interactions between Speakers and Members to occur and we take no responsibility for the contents of any Speaker advertisement or other Content posted to the Website.
1.2 We are not an employer, labour hire firm, employment agency or recruiting firm and we do not take responsibility for:
- any background, financial security or other checks, enquiries or investigations into any Speaker or Member or as to whether any Speaker information or verification is complete or accurate;
- the accuracy of the information provided by Speakers; and
- the selection of Speakers, or the negotiation of any services agreement or or any arrangements between the Members and the Speakers.
- Members wishing to engage Speakers must independently verify and make their own assessment of the suitability and experience of any Speaker for any Engagement. We cannot guarantee that you will locate suitable Speakers for any Engagement.
- Members must independently verify the requirements of any engagement and make your own assessment of your suitability for the Speaker.
- At no time are we responsible for any remuneration, or any costs incurred by any Speaker that are not reimbursed by any Member.
- We are in no way responsible for remitting any tax or other payments to any employment regulator or government department or agency on behalf of any User. We have no affiliation or association with any User at any time beyond providing these Services.
- The use of our Website is intended only for lawful and ethical purposes by Speakers seeking offer their services for any engagement that a Member may require. Users may not use our Website (or encourage or assist others to use it) for any purpose that is prohibited by our Terms or by any applicable law.
- You must be at least 18 years old (or the age of majority in your jurisdiction) and have capacity to enter a contract. By registering and setting up an account, you accept these Terms.
- Account signup and Personal Information
3.1 All Users must register and create an account in order to gain access to this Website and our Services.
- Privacy
- We will at all times comply with the Privacy Act 1988(Cth) and the Australian Privacy Principles (APPs) in relation to personal information, you provide to the Website. Please refer to our full privacy policy on this Website for details of how we collect, store and use your personal information.
- We reserve the right to disclose a User’s name and any other personal information to any law enforcement authority or other competent authority or to any person for the purpose of legal proceedings, prosecution, investigation or any breach or alleged breach of the law or these Terms.
- How the marketplace works
- Speakers may list services at any price (including AU$0 for volunteer speakers). Certain categories (e.g., corporate / academic) may have fixed or recommended fees (for example, AU$280 per engagement), as displayed on Jaabla.
- Members book Speakers by submitting a booking request via the Website and paying the total booking amount at checkout. Unless otherwise agreed, Members pay Speaker Fee + Jaabla Platform Fee (5.5%) + GST. Jaabla’s full fees inclusive of taxes are always shown at checkout. (Example: AU$280 speaker fee → Member pays AU$295.4 + GST.) See Payment Terms.
- Warranties
6.1 Each Speaker warrants that at all times:
- You have the right to work in Australia;
- You have the relevant qualifications and certifications required for the Engagement;
- All the information you have presented and posted including any qualifications is correct, accurate and not misleading.
- Each Member warrants:
- You have provided correct and accurate information around the Engagement;
- You have done your own investigations and verifications to confirm any Speaker suitability for your Engagement;
- You will not use our Services for any illegal, illicit, immoral, unlawful, fraudulent, offensive or otherwise unlawful activities; and
- You have (or will ensure the venue has) the relevant and required insurances to host the Engagement.
- Payment, Cancellation and Refund Terms
7.1 Jaabla uses only secure third-party payment processors (e.g., Stripe or PayPal) to process payments. By using Jaabla you authorise Jaabla and the payment provider to process payments, collect platform fees, and remit speaker payouts.
7.2 Platform fee: Jaabla charges 5.5% of the speaker fee, added on top of the speaker’s listed price paid by the Member, unless otherwise notified.
7.3 The Speaker will pay a 10% fee of the full net Speaker fee to Jaabla. The speaker will -receive 90% of their speaker fee and Jaabla will keep 10% (net of taxes).
7.4 Payouts: Speakers receive payouts to their nominated bank account after event completion and any applicable verification, subject to the payout schedule described on Jaabla. (Replace with your chosen timing — e.g., “within 7 business days after event confirmation”.)
- 5 Taxes:Fees may be shown exclusive or inclusive of GST as indicated; Speakers and Members are responsible for compliance with their own tax obligations in their jurisdictions.
Taxes on orders
- Clients may be charged with indirect taxes (e.g. Sales tax, VAT, or GST) depending on location, and applicable law. This is in addition to the price shown on the site and is always made known before
- The price on the final checkout page includes all fees and GST to be paid by members. They are clearly shown so that you can approve the amount charged.
- Jaabla is unable to accommodate users’ exemptions from state sales/use taxes on orders, however, these can be claimed back from the local authorities (when applicable).
For Australian Clients
- Prices are inclusive of GST where applicable and indicated.
- Australian Speakers must provide an ABN and are responsible for declaring their income to the Australian Taxation Office (ATO).
For International Clients
- For Members outside Australia, Jaabla may collect and remit applicable VAT, GST, or other consumption taxesbased on local laws.
- These taxes will be added to the total order price at checkout where legally required.
For International Speakers
- International Speakers may be required to submit tax forms (e.g., W-8BEN) to comply with cross-border tax regulations.
- Jaabla does not withhold income tax on behalf of Speakers. Each Speaker is responsible for reporting and paying tax in their country of residence.
Speaker taxes
- According to our Terms of Service, speakers are responsiblefor their local tax obligations.
- Statement of earnings
Jaabla can issue a statement of earnings upon request.
Note: This document can only be issued for completed years (for example, January – December 2025) and it cannot be issued for shorter periods or for single months (for example, January – June 2026, or just June 2026).
- Cancellations & Refunds
9.1 Members must cancel the Engagement up to 7 days prior to the Engagement to receive a full refund less processing fees. For any cancellations after this time but 5 days prior to the Engagement, Members will receive a 50% refund less processing fees. Any cancellation within 24 hours of the Engagement will forfeit a refund.
9.2 In the event a Speaker does not attend or cancels, the Member receives a full refund including all processing fees.
- Speaker obligations
10.1 Speakers will at all times provide services professionally and on the agreed date/time. Any ‘no show’ by any Speaker will be reported promptly by the Member and the Speaker may be removed from the Jaabla platform where there are multiple complaints or otherwise in our sole discretion.
10.2 Speakers will at all times comply with local laws and obtain any permits/consents required.
10.3 Speakers warrant they will at all times provide and maintain accurate profile, experience, certifications, availability and pricing information on their information.
10.4 Speakers will use best endeavours to comply with any event-specific instructions from Members as reasonably required.
- Member obligations
11.1 Members must provide accurate event details and communicate promptly and clearly with Speakers.
- 2 Members will obtain any required permits or consents to host the Engagement and Speaker.
11.3 Members will pay promptly all stated Speaker fees.
11.4 Members will at all times, treat Speakers respectfully and professionally.
- 5 Members will ensure all venues for Engagements have appropriate insurances in place to protect Speakers.
11.6 Members will report any ‘no show’, impropriety or other issues with any Speaker in writing promptly to Jaabla.
- Intellectual Property
12.1 All custom graphics, icons, logos and service names are our registered trademarks, copyright, trade or service marks.
- 2 All other trademarks or service marks within this Website are the property of their respective owners. Nothing in these Terms grants Users any right to use any trademark, service mark, logo, and/or our name or anything you access through our Services.
12.3 Users agree and acknowledge that we retain all right, title and interest in the Services, including but not limited to the inventions and intellectual property rights contained or embodied within the Services.
- 4 Users are solely responsible for obtaining written permission before re-using any copyrighted material that is available on this Website. Any unauthorized use of the material appearing on this Website may violate copyright, trademark and other applicable laws and could result in criminal or civil penalties.
- Limitation of Liability
- Under no circumstances will we be responsible for any loss, damage, injury or death resulting fromany User failing to comply with their obligations under the relevant workplace health and safety legislation, or contractual obligations or obligations arising under the law of negligence.
- Certain legislation including the Australian Consumer Law(ACL) in the Consumer and Competition Act 2010 (Cth), and similar consumer protection laws and regulations may confer you with rights, warranties, guarantees and remedies relating to the provision of services by us to you which cannot be excluded, restricted or modified (Statutory Rights).
- Our liability to you is governed solely by the ACL and these Terms. We make no representations or warranties of any kind, express or implied, about:
- the completeness, accuracy or reliability of the information you obtain from the use of our Services; or
- whether the Services provided on the Website will be available on an uninterrupted, secure or error-free basis.
- We expressly disclaim all conditions and warranties implied by custom, law or statute except for your Statutory Rights.
- Subject to your Statutory Rights, we will in no way be liable to Users for any direct, indirect, incidental, special, or consequential loss or damage of any nature or type (including any physical, mental or emotional injury, death, loss of opportunity or loss of revenue or profits) as a result of your use of this Website, or anything related directly or indirectly to your use of our Services. We also do not accept any responsibility for and are not liable for any loss or damage resulting from reliance by any User of any information on this Website or accessed by any User though the Services provided on this Website.
- When your Statutory Rights apply, to the extent possible, our liability in respect of any claim is limited to, at our option:
- The supply of any Services again; or
- The payment of the cost of having any services supplied again, and
in any event, our liability to you will not exceed AUD$100.
- Our failure to exercise or enforce any right or provision of these Terms will not constitute a waiver of such right or provision.
- No agency, partnership, joint venture, or employment relationship is created between you and us as a result of these Terms and you do not have any authority of any kind to bind us in any respect whatsoever.
- Indemnity
14.1 We are a third-party facilitator offering a platform to enable individuals and organisations to book speaker engagements for events only. At no time are we responsible for any activities that may occur at the Engagements or between the Speakers and Members apart from running the Platform and ensuring prompt payments for services.
14. 2 We do not check the credentials, experience, Engagement details or other information provided by any User. It is your obligation to do your own research to ensure that any Speaker is suitable for your Engagement and that the Engagement is suitable for any Speaker. We are not responsible for verification of any materials provided or events.
14.3 You rely on any such information provided by any Member or Speaker at your own risk. You agree to defend, indemnify and hold us, our officers, directors, employees and contractors from and against any and all claims, charges, actions, liabilities, investigations, demands and similar including but not limited to any third party claims, costs, losses, damages whether direct, indirect, consequential or special and all legal fees that we may incur, including but not limited to any civil penalties which may be imposed as a result of your breach of any warranties or other provisions of these Terms.
15. Cancellation and Termination of Your Access to the Website
- Users agree that we may, in our sole discretion, terminate or suspend your access to the website with or without notice and for any reason, including, without limitation:
- your breach of these Terms;
- any suspected misleading or deceptive, fraudulent, abusive or illegal activity you engage in, or benefit from, in relation to your use of the Services;
- your providing false or misleading information when you complete the Webform to subscribe to the Services provided on our Website or when you change your information on our Website; or
- numerous complaints about your behaviour, misleading information, or any other reason in our sole discretion.
- Upon such termination or suspension of a User’s account, regardless of the reasons, the right of the User to access and use the Website immediately ceases and we may immediately deactivate your profile or delete the User’s account and all Advertising Material, Content and other information.
- We will not be liable to the User, whose account has been terminated or suspended, for:
- any refund of fees; and
- any claims or damages made by the User arising out of any termination or suspension or any other actions taken by us in connection with such termination or suspension.
- If you want to cancel your subscription to our Website, you must inform us in writing by email so that we can deactivate your account/terminate your account using the customer information form on our Website.
- We reserve the right to disclose the name and any other personal information of a User to any law enforcement authority or other competent authority or to any person for the purpose of legal proceedings, prosecution, investigation or any breach, alleged breach of the law or these Terms.
- Mediation and Dispute Resolution
16.1 We encourage Users to try and resolve disputes directly. All Users agree we are no to be involved unless there is a claim which is a direct result of our action or inaction.
16.2 We encourage any dispute that cannot be resolved between the parties to be otherwise resolved through mediation provided by a provider of alternative dispute resolution (ADR) services. The Users are responsible for paying any costs associated with the ADR service in accordance with the terms and conditions of the ADR service.
16.3 If a dispute, claim or issue arises between any User in connection with our Services or these Terms:
- the dispute, claim or issue arising out of or in connection with our Services may be settled by confidential mediation at either party’s election and each party will bear its own costs for the ADR services; and
- those parties agree that confidentiality is paramount to the reputation of those parties. At no time must any communications or discussions be made public, including but not limited to any social media websites. Any public discussion or comments about a party are considered defamatory, negative or otherwise damaging and will be the subject of compensation in any mediation or litigation claim.
- Partial Invalidity of Provisions
17.1 If any provision of these Terms is void, illegal, invalid, or unenforceable in whole or in part, such provision will be severable from all other provisions herein and will not affect or impair the validity or enforceability of any other provisions of this agreement; provided, however, that a court having jurisdiction may revise such provision to the extent necessary to make such provision valid and enforceable.
17.2 Where any provision of these Terms would by any applicable statute be illegal, void, or unenforceable in any State or Territory of Australia then such provision shall not apply in that State or Territory and will be deemed never to have been included in these terms and conditions in that State or Territory. Such a provision if legal and enforceable in any other State or Territory shall continue to be fully enforceable and part of this agreement in those other States and Territories. The deemed exclusion of any term pursuant to this paragraph will not affect or modify the full enforceability and construction of the other provisions of these Terms.
- Whole Agreement
These terms and conditions represent the whole agreement between you and us concerning your use and access to our website and your use and access to the documents and information on it. No other term is to be included in this agreement except where it is required to be included by any legislation of the Commonwealth of Australia or any State or Territory of Australia.
- Governing Law & Jurisdiction
These Terms are governed by the laws of Queensland Australia. You agree to the exclusive jurisdiction of the courts of Queensland for any dispute concerning these Terms.
These Terms were last modified September 2025 and are effective from that date.
